Seat Belt Use Regulations

Many of you have company policies which state that any occupant of a company CMV be properly restrained in a seat belt in your CMV when the CMV is in operation. However, this is a reminder to all companies operating property -arrying CMVs that the driver is responsible to make sure the passenger is in a seatbelt before the CMV can begin operation effective 08-08-2016. Please review this information on passenger in a property-carrying Commercial Motor Vehicle (CMV) being required to be seat-belted in during operation of the CMV. Effective date of the new federal regulation again is August 8th, 2016.

392.16 Use of seat belts.

(a) Drivers. No driver shall operate a property-carrying commercial motor vehicle, and a motor carrier shall not require or permit a driver to operate a property-carrying commercial motor vehicle, that has a seat belt assembly installed at the driver's seat unless the driver is properly restrained by the seat belt assembly. (b) Passengers. No driver shall operate a property-carrying commercial motor vehicle, and a motor carrier shall not require or permit a driver to operate a property-carrying commercial motor vehicle, that has seat belt assemblies installed at the seats for other occupants of the vehicle unless all other occupants are properly restrained by such seat belt assemblies.

What is a property-carrying CMV:

Commercial motor vehicle means any self-propelled or towed motor vehicle used on a highway in interstate commerce to transport passengers or property when the vehicle—

(1) Has a gross vehicle weight rating or gross combination weight rating, or gross vehicle weight or gross combination weight, of 4,536 kg (10,001 pounds) or more, whichever is greater.
